The Sentinel 06/13/2012 THE TEA PARTYER June 12, 2012 If college students are complaining about the high price of tuition, wait till they have to pay the cost of getting the education of experience. On June 4, 2012 at a regularly scheduled council meeting, the Bandon City Council was reviewing a request for the use of the city’s water service. It was a simple request from a resident living outside the city limits who wanted to extend the city’s water lines to their house. The council denied the request for service in the past on the grounds the property was outside the city’s Urban Growth Boundary (UGB). The resident, Dave Schradieck, appealed the city councils denial for service arguing that he bought the property under the impression he could hook-up future dwellings to city water. He astutely argued that the end of his driveway was inside the UGB and that fact granted right to receive service. It would be a natural conclusion to believe if one part of the property is entitled to city utilities then the rest of the property is entitled as well, even though a portion of it is physically outside the UGB. The refusal of access to one of life’s essentials---water---is reprehensible under the circumstances. However, what was really frightening and very revealing is the actual underlying reason for the denial. Several years back the city was interested in annexing the area in which the aforementioned piece of property was located. The owner of the property, Mr. Schradieck, had the foresight and intelligence to fight against the city’s attempt to attain more territory and led the opposition to the annexation. Unfortunately, it is rare for the city to forgive, much less forget those who question their authority. On several occasions during the debate at the council meeting the issue of Mr. Schradieck’s opposition to annexation came to the forefront of the conversation. The City Manager pointed out that every water customer living outside the city limits has to sign away the right to fight against annexation, which is very heavy handed on the side of the city. These forced waivers create an environment where city officials have the means and motive to seek retribution against anyone who chooses to invoke constitutional rights. The story proves the point that politics and politicians should never be allowed in the realm of business. Especially, if that business is providing a necessity. Can you imagine the public outcry if this was a private corporation using the same type of tactics against their customers or competitors? At least people can choose not to patronize an individual corporation. It takes 2 to 4 years to vote bad politicians out of office. By that time who knows how many people have been abused by the system and without any public outcry this will become standard procedure for all future government programs. The Bandon city councilors voted against the property owner instead of easily changing a few lines on a map allowing the availability of their services. A private company would not have hesitated a second and would have jumped at the advantage of getting another paying customer on the books. It is the main goal of business to generate more revenue, not to blackball clients. Also, private business does not use a customer’s political background or ideological beliefs as criteria for doing business and if they do, then go somewhere else. The City of Bandon and government in general does not have to worry about getting, keeping or pleasing consumers to generate revenue to stay in business, because government can always rely on taking more money from the taxpayer to foot the bill. Giving bureaucrats leverage to wield like a hammer over the electorate is a dangerous proposition and one that should be thought out thoroughly before investing more public funding into other types of private-public partnerships that are increasingly occurring in the economy today. “Rob Taylor was the original organizer of the TEA Parties in Coos County and is currently an independent activist working to promote the rights of the individual.” Related Posts: A Meeting About Nothing.... The auction of 11 special big game tags grossed $347,000 including $110,000 for a bighorn sheep tag. The sportsman/conservation groups that sponsored the auctions at various meetings and conventions of their organizations in the past few months will keep 10 percent of the auction proceeds ($34,700). Those groups include state and/or national chapters of the Mule Deer Foundation, Safari Club International, Wild Sheep Foundation, Oregon Bow Hunters, Rocky Mt Elk Foundation, and the Oregon Hunters Association. Raffle winners were drawn at the Oregon Hunters Association convention on May 19, 2012 in Redmond. Local Tea Party groups have begun petitioning their local governments to withdraw from membership in the ICLEI USA. The Republican National Committee in January passed a resolution exposing U.N. Agenda 21 and warning against its implementation. And now seven states have proposed similar resolutions to warn their citizens, policymakers and local governments about the dangers of enda 21. But the fight is proving to be an uphill battle that needs grassroots Americans to make their voices heard in order to win. The Tennessee legislature passed an anti-Agenda 21 resolution, but Governor Bill Haslam refused to sign it. This drastic reduction in manageable land reduced the amount of timber available annually from 4.5 billion to 1.1 billion board feet. This reduction, coupled with the fact that less than 40 percent of the projected 1.1 billion was ever made available for harvest, led to the closure of 261 mills supporting at least 50,000 jobs in western Washington, western Oregon and northern California. Based on a conservative production estimate of at least 500 board-feet per acre per year, growth on the Northwest Forest Plan acres since 1994 has been in the neighborhood of 12.1 billion board feet per year. The annual harvest has been only about 4 percent of growth. Karla Kay Edwards Oregon State Director Americans for Prosperity The Sentinel 6/6/2012 THE TEA PARTYER June 5, 2012 On Wednesday May 30, 2012 the Bureau of Land Management held a public meeting to get comments and suggestions for the bureau’s process of revising Resource Management Plans (RMP) for 2.5 million acres of forested lands across six of the bureau’s Districts in western Oregon. It is the latest in an effort by the Department of Interior to use one of its agencies to expand the level of control of the Dept. over the individual states. The Department’s motive is to eventually seize the natural resources of the country and exploit those resources for their own purposes---all to the detriment of the states. The bureau will call for public input, but most of the decisions seem to have already been made in D.C. The public has to contact the 23 Members of the House Subcommittee on National Parks, Forests & Public Lands and let them know you are concerned with these latest actions. The website for this subcommittee is www.naturalresources.house.gov. These members of congress control the purse strings for the budget of The Department of Interior and they must be told to stop allocating money to fund these studies and more land acquisitions. This is the same subcommittee that controls the funding of the US Fish & Wildlife Service, which is in the process of moving forward with the Bandon Marsh Expansion, among other land grabs in Oregon. It is equally important for people to contact The Bureau by June 7, 2012 when the public scoping period ends. After that time The B.L.M. will move forward with these Resource Management Plans making it more difficult to stop the process once started. The Bureau is a job killer Taking those facts into consideration here are my suggestions for The Bureau of Land Management’s Resource Management Plans: Stop wasting tax dollars on useless studies designed to put up barriers between the tax-paying and public property. Stop wasting public resources on any resource management plan or “RMP.” Stop any study or plan to increase the habitat of any creature other than humans. Stop putting the needs of wildlife over the survival of humans. Stop expanding the bureau’s area, domain, protection zone, space, territory, or sphere of influence in Coos County and the state of Oregon. The Bureau should return all the public land within state lines to the respective county’s Board of Commissioners. The Bureau of Land Management is an antiquated, obsolete, over bloated agency and should be eliminated by the US Congress. The Department Of Interior is an abusive authority driven by ideological environmental extremism and should be swiftly & severely defunded by the US Congress, until the agency’s main purpose of existence is to serve the people and only people of the United States. Secretary of State Ken Salazar should be fired for his insubordination to the people he serves and the subversion of the US Constitution. I've been "Tea Party" since 1996, when I started publicly stumping for individual rights, Constitutionally-limited government and fiscal restraint in the public sector. Gary Johnson has been "Tea Party" in the same sense since 1994. Johnson spent eight years as Governor of New Mexico supporting "Tea Party" values -- he kept the state in the black for all of that time, while managing to get re-elected in a state that's 2-to-1 of the opposing party. During those eight years, Johnson never treated gun owners (or any other group, that I could tell) as a political soccer ball, to be kicked around from the bully pulpit at a whim. There's a reason they call it the /bully/ pulpit. This stands in stark contrast to any other of the candidates for the presidency that I've seen. Most of them like to rhetorically stomp on one group or another for political brownie points. Not so with Gary Johnson. None are as . . . /presidential/ as Johnson. As for the other "big two" -- both are anti-gun-owner bigots at heart, and the one who was a governor signed off on a plan to take over health care that was plagiarized on the national scene by the staff of the one who was a senator. The big differences between them don't seem to be of philosophy or ethics, but of severity and priorities. Concerning the U.S. Senate seat from New Mexico that's up for grabs --New Mexicans can play eenie-weenie-mighty-mo with the two socialist candidates who won the primaries last night. Or they can vote "Tea Party" by supporting Jon Barrie. I've never met Jon, but I'd like to. He's campaigning as a Christian conservative, yet was recommended to me by a long-time libertarian who's an enthusiastic pot smoker and atheist. Jon appears to be running his campaign the way a campaign should be run -- by volunteers on a shoestring budget. Thus he needs all the help we can give him. June 6, 2012 SAOVA friends, As you know by now, APHIS proposes to revise the definition of "retail pet store" to bring more pet animals sold at retail under the Animal Welfare Act (AWA) licensing and regulations. APHIS plans to narrow the definition of retail pet store so that it means a PLACE OF BUSINESS OR RESIDENCE THAT EACH BUYER PHYSICALLY ENTERS in order to personally observe the animals available for sale prior to purchase and/or to take custody of the animals after purchase. Under the proposed rule no dog or other pet animal will be sold at retail WITHOUT either public or APHIS oversight. This is the critical point. WHAT WE KNOW - For decades pet sellers in the retail sector have enjoyed immunity from federal licensing under the definition of a "retail pet store". Historically retail sellers were not licensed by the federal government due to the general ability of the public to provide their own scrutiny of pet sellers and government concerns such as duplicative efforts with state or local laws. - The proposed rule change has been circulated in the media and by HSUS as "closing an Internet loophole" in the AWA that will bring regulation to unscrupulous dog breeders who operate in substandard conditions. Far from it!! The broad scope of the proposed rule could bring hundreds of thousands of pet retailers and rescuers of domestic animals under federal regulation. - A breeder/seller of any species currently covered under the "retail pet store" definition can potentially lose their exemption and be required to obtain a federal license for even occasionally selling sight unseen via the Internet. "Covered" species includes dogs, cats, rabbits, guinea pigs, hamsters, gerbils, rats, mice, gophers, chinchilla, domestic ferrets, domestic farm animals, birds. - The proposed rule would require EVERY SINGLE BUYER to physically visit a retailer's premises. Therefore selling even one pet OFF PREMISES at a show, at a park, or arranged location without the buyer visiting first, will result in loss of an exemption from federal licensing. Rescue organizations are NOT exempt from this proposed rule. Selling pets at an adoption day event away from their base location or traveling to meet potential adopters would no longer be permitted without a federal license. This proposed requirement places undue limitations on buyers as well as sellers. - Living under USDA licensing is NOT an option for the average retail seller. Spare rooms in homes, porches, covered kennel runs, and barns can never be converted to a USDA-compliant facility. Federal engineered standards for licensed facilities dictate enclosure sizes, sanitation, surfaces that are impervious to moisture, ventilation, bio-hazard control, veterinary care, exercise, temperature controls, waste disposal systems, diurnal lighting, drainage systems, washrooms, perimeter fencing, as well as transportation standards for regulated animals. Most residential environments would not permit zoning variances for such facilities. - Exemptions from licensing are limited. Breeders of cats, dogs, and small exotic animals are currently exempt if they have 3 or fewer breeding females. APHIS proposes to increase this to 4 or fewer breeding females. However, either limit makes it very difficult to build a breeding program without constantly moving out or spaying older females to make room for the next generation. To have more than this number of breeding females requires a license. - There is still an exemption for sellers who derive less than $500 gross income from the sale of other animals (this does not include dogs, cats, and exotic or wild animals). - The massive expansion of regulatory responsibilities into the private sector outlined in the proposed rule is not only impractical but unaffordable for an agency that is currently addressing serious budget challenges. For the past several years, APHIS' budget has been shrinking; since 2010 the budget has decreased by roughly 10 percent. The 2013 submitted budget calls for an additional decrease of 6.6%. ACTION REQUIRED OPPOSE adoption of this proposed rule. APHIS needs to hear most from those who are likely to be affected by the rule. Explain briefly how the rule will impose costs on your breeding program and activities and whether this will cause you to cease or limit your hobby or operations.
